银行骗贷是指行为人以非法占有为目的，用虚构事实或隐瞒真相的方法，使处于与其金融交易地位相对的银行或者其他金融机构陷于认识错误或持续认识错误，因而自动地向行为人或其指定的第三人交付数额较大的贷款，从而主要侵害了信贷秩序并同时侵犯了公私财产所有权，触犯刑法并应当负刑事责任的行为。

普通骗贷指贷款人向民间贷款机构进行贷款的骗取，受害人不一定是银行，也可以是民间机构或者个人。

贷款诈骗罪是指以非法占有为目的，诈骗银行或其他金融机构的贷款，数额较大的行为。

贷款诈骗罪的构成要件如下：

1.本罪侵犯的客体是双重客体，即不仅侵犯了银行或其他金融对贷款资金的所有权，而且侵犯了国家对金融机构的贷款管理秩序。

2.本罪在客观方面表现为行为人用虚构事实或者隐瞒真相的方法，骗取银行或其他金融机构的贷款，数额较大的行为。

《刑法》第193条明确规定了贷款诈骗的几种主要形式：

(1)编造引进资金、项目等虚假理由骗取贷款。犯罪分子一般打着发展地方经济的幌子，编造一些根本不存在的项目或引进资金，然后寻求政府和银行等金融机构放贷，解决资金暂时困难，实际上这些所谓的项目和引进资金都是骗取金融机构资金的一个幌子。

(2)使用虚假的经济合同骗取贷款。司法实践中，为骗取贷款而伪造经济合同的，主要有以下几种形式：①伪造对方单位的公章和法人代表私章。②合同双方恶意串通，为达到骗取贷款的目的，订立实际上不准备履行的合同。③利用原来签订的现已失效的合同，更改有关条

款，充当新的合同。

(3)使用虚假的证明文件骗取金融机构的贷款。这里所说的证明文件，是指在向银行或其他金融机构申请贷款时所需要的文件，包括银行的存款证明，公司和金融机构的担保函，划款证明，营业执照等。例如，广西柳州市三朦工贸有限公司麻琳、姜保林、徐洪贷款诈骗案。麻琳、姜保林、徐洪等人以高息为诱饵，欺骗有关单位和个人将款存入其指定的金融机构，并提供存单复印件和一份在约定时间内不提前支取的保证书，以此骗取金融单位贷款。他们先后采用偷盖储户印章等方法制作假委托书，从柳州市4家金融机构骗出贷款115笔共1.2813亿元人民币。此外，被告还先后采用制作假转帐支票、汇票的方法，作案22起，共用假印章冒充储户名义制作并使用假转账支票70张，汇票4张，从柳州市5家金融机构骗取资金1.4152亿元。案发后追回赃款、赃物共计人民币1.085亿元。此案经审理，法院判处麻琳、姜保林一审死刑，徐洪被判处死缓，其余5人分别被判有期徒刑10至15年。

(4)使用虚假的产权证明作担保或者超出抵押物价值重复担保，骗取银行或者其他金融机构的贷款。所谓产权证明，是指能够证明行为人对房屋、土地等不动产或汽车、贷币、可即时兑付的票据等动产享有所有权的书面文件。所谓抵押物，是指债务人或者第三人为履行债务而提供的担保财产，包括动产和不动产。

(5)以其他方法骗取银行或其他金融机构的贷款。所谓其他方法，是指前四种方法以外的诈骗贷款的方法，如伪造单位公章、印鉴骗取贷款，借贷后故意转移资金拒不归还的，等等。

此外，本罪属于数额犯，只有诈骗贷款数额较大的行为，才能构成犯罪。如果数额不大，则不构成犯罪。至于何谓“数额较大”，有待司法解释明确。目前的司法实践中，一般把1万元作为个人贷款诈骗“数额较大”的标准。个人诈骗贷款5万元以上的为“数额巨大”，个人诈骗贷款20万元以上的为“数额特别巨大”。

3.本罪的主体是一般主体，自然人都可构成本罪主体。单位不能成为本罪的主体。

4.本罪在主观方面是直接故意，并且必须具有非法占有贷款资金的目的。如果行为人不具有非法占有贷款资金的目的，即使在申请贷款时使用了欺诈手段，也不能构成本罪。至于行为人出于何种动机，是为了挥霍享受还是转移隐匿都不影响本罪的成立。
