3. The engaged party works five days a week and seven hours a day. The engaged party will have legal holidays as prescribed by both American and Chinese governments. The summer and winter vacations are fixed by the school calendar.

4.聘方每月支付给受聘方工资叁仟圆（3，000）人民币，并按照政府对在华工作的外籍教师的.规定提供各种福利待遇。

4. The engaging party pays the engaged party a monthly salary of three thousand (3 ， 000) Chinese Yuan (RMB) and provides him with various benefits as prescribed by Chinese . Government for foreign teachers working in China.

5.受聘方在入境、离境或过境时，必须遵守政府有关外国人居住、工资福利及旅行等的法律、规章，”并应遵守聘方的工作制度。

5. The engaged party shall abide by the laws and regulations of the Chinese Government concerning residence， wages and benefits， and travel for foreigners when entering， leaving and passing through the territory of the country， and shall follow the working system of the engaging party.

6.双方均不得无故撤销合同。如果聘方要求中途终止合同，除按上述条款承担工资福利待遇外，须给受聘方增发两个月的工资作为补偿金，并于一个月内安排受聘方及其家属回国并负担有关费用。如果受聘方中途提出辞职，聘方自同意之日起即停发工资；受聘方不再享受各项福利待遇；受聘方及其家属回国的一切费用均由本人自理。

6. Neither party shall cancel the Contract without reasonable causes.

If the engaging party finds it imperative to terminate the Contract， then， in addition to bearing the above-mentioned wages and benefits， it shall pay the engaged party two months extra salary as compensation allowance， and arrange at its own cost for him and his family to go back to their country within one month.

If the engaged party submits his resignation in the course of his service ， the engaging party will stop paying him salary from the date when his resignation is approved by the engaging party， and the engaged party will no longer enjoy the benefits. When leaving China， the engaged party and his family will have to pay for everything themselves.

7.本合同自受聘方到校之日起生效，到聘期届满时失效。如一方要求延长聘期，必须在合同期满前一个月书面向对方提出，经双方协商同意后另签延聘合同。

If either party wishes to renew the Contract， the other party shall be notified in writing one month before it expires. Upon agreement by both parties through consultation ， a new contract may be signed between two parties.

1、下列情况下，聘用方有权书面通知外籍教师终止合同：

如外籍教师违反中国的法律法规、聘用方的工作制度、中国政府关于外籍专家的相关规章制度或者合同的其他条款。此种情况，无补偿；

如外籍教师表现不佳，不能尽责者，聘用方有权立即终止合同，外籍教师将得到十五天的工资作为补偿金；如聘用方决定给予15天的时间允许其改进工作，但到期后其工作表现仍不能令聘用方满意者，合同将被终止，聘用方无须提供额外补偿；

If the Foreign Teacher fails to satisfactory perform his/her duties and responsibilities, the contract will be terminated immediately, but the foreign teacher will receive fifteen days’ severance pay;Or, at he sole discretion of the Employer, the Foreign Teacher will be given fifteen days to improve his/her job performance.If, after fifteen days, the Foreign Teacher has not improved his/her job

performance to the satisfaction of the Employer, the contract will then be terminated and the Foreign Teacher will not receive any additional pay;在连续30天病假后，经合格医生诊断外籍教师不能继续履行其工作职责的。

七、合同的变更、解除和终止：

双方应信守合同，未经双方一致同意，任何一方不得擅自变更、解除和终止合同。

（一）合同的变更。经当事人双方协商同意后，可以变更。在未达成一致意见前，仍应当严格履行合同。

（二）合同的解除。经当事人双方协商同意后，可以解除合同。在未达成一致意见前，仍应当严格履行合同。

1、聘方在下述条件下，有权以书面形式通知受聘方解除合同：

2、受聘方在下述情况下，有权以书面形式通知聘方解除合同：

（1）聘方未按合同约定提供受聘方必要的工作和生活条件；

（2）聘方未按时支付受聘方报酬。

3、当事人一方要求解除合同，应提前30天以书面形式向另一方提出，30天以后方可解除合同。

4、双方协商一致，可以解除合同。

（三）合同的终止。

1、合同期满该合同即告终止。

2、经当事人双方协商同意后，也可以终止该合同。在未达成一致意见前，仍应当严格履行合同。

八、违约金：

当事人一方不履行合同或者未完全履行合同所规定的义务，即为违反合同，应当向另一方支付800-3000美元或相当于受聘方月工资3到10倍数额人民币的违约金。如双方认为有必要约定确切数额或更高或更低的违约金，应当在合同附件中写明。

受聘方因不可抗力事件要求解除合同，需出具有关机构证明。经聘方同意解除合同后，受聘方离华的费用自理；受聘方若无故解除合同，除离华费用自理外，还应当向聘方支付违约金。

b.On the basis of the physician’s diagnosis, Party B fails to resume normal work after a sick leave for a period of successive 30 days.(2)

Party B has the right to inform Party A in writing of the cancellation of this contract under the following conditions:

a.Party A fails to provide Party B with necessary working and living conditions as stipulated in this contract;

b.Party A fails to pay Party B as scheduled.(3)

In case either party asks to terminate this contract, it shall give a 30 day notice to the other party in writing, and the contract shall only be terminated after 30 days.(4)

This contract can be terminated upon mutual agreement by both parties.3.Termination of the contract.(1)

This contract shall be terminated once it expires.(2)

This contract may be terminated with the mutual consent of both parties, and it shall be strictly observed until both parties reach an agreement otherwise.VIII.Breach Penalty

When either party fails to fulfill any part or all of the obligations as stipulated in this contract, that is, in the event of breach of the contract, the said part shall pay a breach penalty of US$800 to 3000 or equivalent to 3 to 10 times Party B’s monthly salary in RMB.If both parties consider it necessary to determine an exact sum of the breach penalty, or to determine a breach penalty higher of lower than the above-mentioned amount, it shall be explicated in the appendix of this contract.When Party B claims to cancel this contract due to force majeure, it shall produce certifying documents issued by competent authorities;after the contract is cancelled with Party A’s consent, Party B shall bear the traveling expenses thus incurred;and when Party B fails to provide any valid reason to cancel this contract, it shall bear the traveling expenses thus incurred and pay the breach penalty to Party A as stipulated in this contract.When Party A claims to cancel this contract due to force majeure, and the contract is thus cancelled with Party B consent, it shall bear Party B’s traveling expenses thus incurred;and when Party A fails to provide any valid reason to cancel this contract, it shall bear the traveling expenses thus incurred to Party B and pay the breach penalty to Party B as stipulated in this contract.IX.The appendix of this contract forms an indispensable part of this contract and shall have the same legal effect with the text of this contract.X.This contract shall take effect upon being signed by both parties and shall be automatically terminated upon expiration.When either party requires signing a renewed contract, it shall forward its request to the other party 30 days prior to the expiration of this contract, and both parties shall sign the new contract through consultations and mutual consent.Upon the expiration of this contract, Party B shall bear all the expenses incurred during his own stay in China.XI.Settlement to Dispute
