introducing brokers have certain responsibilities to clients and snc ?with respect to their introduced accounts:

篇7：退运协议中英文
近年来,国际经济秩序、贸易形势、我国对外贸易发展及检验监管工作等情况都发生了重大变化。在当今竞争日趋激烈的社会环境中,如何发挥检验检疫部门的监管作用;如何帮助我国的企业在世界范围内的竞争中得以生存并获得发展;如何帮助企业提高产品质量,增强竞争力[1]。这些问题是国内众多企业所面临的和急切需要解决的当务之急,也是我国检验检疫监管部门应该思考的问题。本文结合检验检疫监管中的退运调查工作内容,做好新形势下的出口退运调查工作,并应用于企业持续质量改进,帮扶企业改进产品质量,提升企业竞争力,以提高检验监管工作的有效性。
1 基本知识
(1)出口退运调查的概念
出口退运调查是检验监管工作的重要组成部分,是由检验检疫机构对由中华人民共和国境内工业产品生产企业生产出口并被境外官方或相关贸易人退回的产品开展信息收集、原因调查、风险研判、信息处置,以及对出口退运货物的责任认定及责任追究等管理工作。
为加强对出口工业产品退运货物追溯调查管理工作,及时掌握出口退运货物的质量动态,强化对出口工业产品的风险预警措施,并加强对出口生产企业的后续监督管理力度,进一步提高检验检疫部门的工作质量和依法把关水平。根据相关法律法规,国家质检总局制定了关于出口工业产品退运调查的规范。
(2)出口退运原因的分类
出口工业产品退运原因一般情况下分为两类。
一类是因质量原因而退运:质量问题涉及安全、卫生、环保和健康等不合格项目;外贸合同订明相关质量条款,且该条款与退运原因相关联;被境外官方以召回、下架或通报等方式予以强制退回;境外客户退运理由涉及技术性贸易壁垒等;质量问题发生在商品质量保证期内;涉及数量、重量或包装不符等问题。
另外一类是因非质量原因而退运:存在运输过程中残损、交货期延误、违反信用证条款等无法履行贸易合同的问题;属于超过商品质量保证期的维修行为;属于商品质量保证期内的消费者使用不当原因;在贸易过程中发生不可抗力事件等。
属于质量原因而退运存在三种可能:退运货物涉及的不合格项目未经过检验;或者采用的检验标准和方法不准确;或者检验检疫机构对该批货物实施的检验监管模式不恰当。
(3)持续质量改进
ISO9001:2008中指出持续改进是“增强满足要求的能力的循环活动”。持续改进的重点是改善产品的特性,提高质量管理体系运行的有效性,增强顾客的满意[1]。
上海电机学院的康军在《通过QC小组实现企业的持续质量改进》一文中指出企业的改进有偶尔改进、阶段改进和持续改进之分,即:点线面。
1)点,即为偶尔改进。针对问题进行纠正和预防,解决并消灭当前问题,是就问题而处理问题,是短期的、随机的。即有问题时,企业进行追根求源,寻找解决问题的方法并解决问题。但这是一种被动的改进方式[1]。
2)线,即为阶段改进。事先确定目标,主动寻求解决问题的方法,除了采取纠正措施外,更要采取预防措施,通过预防措施,防止问题的再次出现,实现阶段改进[1]。
3)面,即为持续改进。通过不断的偶尔改进、阶段改进,不断的纠正、预防和内部管理的提升,逐步实现持续改进[2]。
2 出口退运与持续质量改进的结合
出口工业产品退运货物从境外报检入境,由检验检疫机构对货物进行追溯调查。出口退运货物追溯调查管理工作包括对出口退运货物信息收集、追溯调查、风险研判和信息处置,责任认定和责任追究等。退运货物原因反馈到企业,由企业组织设计开发、QC、工程、生产等部门对照原因采取相应措施,改进产品质量。流程如图1所示。但是,这里所示的改进是针对问题进行纠正和预防,解决并消灭当前问题,是偶尔改进。
结合关于“点线面”持续质量改进的理论,分析上述的检验检疫出口退运调查工作存在如下几个不足。
一是检验检疫机构开展退运调查工作取得退运货物的信息,而出现产品质量问题的企业根据该信息采取具体改进措施。这是针对问题而解决问题,是偶尔改进,停留在点的层次,未达到线和面的层次。即未实现持续改进。
二是企业内部对退运货物信息的处理问题。当企业出现出口货物退运的情况时候,被动地了解货物退运原因,再根据该原因“按图索骥”找出问题出现的根本,进而分析问题,采取改进措施解决问题。这仍然属于点层次的改进。
三是检验检疫机构信息来源局限性,信息不够全面,信息量不够。
四是检验检疫机构信息反馈渠道封闭,调查结果信息只针对发生问题的企业反馈,未向同行的企业反馈,没做到信息共享,使得检验检疫部门工作的有效性“打折扣”。
针对上述的不足,笔者提出构建出口退运调查数据库,实现数据共享,应用于企业的持续质量改进。出口退运与持续改进结构关系如图2所示。
拓宽信息来源渠道,增加信息量。除追溯调查得到的信息之外,另有相关口岸部门提供的信息,国家质检总局下发的信息,投诉举报信息,国外通报的信息,媒体公布的信息以及其他途径来的信息。
设置退运货物信息开放式数据库,做到信息共享。出口退运货物追溯调查结果除针对问题发生的企业,由检验检疫部门监管企业对该问题进行改进,实现偶尔改进。同时要求企业采取预防措施,通过预防措施,防止问题的再次出现,实现阶段改进。且信息对同行业企业开放,做到信息共享。
企业在进行改进的过程中,可以通过检验检疫机构构建的出口退运数据库,提取适合自身企业或者适合自己产品的数据,然后把可能出现产品质量问题的数据应用于企业各部门的日常管理和日常生产。通过偶尔改进和阶段改进的结合实现持续改进,以达到面的层次。
3 小结
检验检疫机构对出口工业产品退运货物追溯调查管理,及时掌握出口退运货物情况,拓宽退运货物信息来源渠道,建立出口退运调查结果数据库。把信息反馈给问题发生的企业,企业通过针对问题解决问题,实现点层面的改进。另外实现数据共享,使得检验监管下的同行企业能获取信息,与企业的持续质量改进相结合,既可以提高检验检疫工作质量和依法把关水平以及检验检疫服务工作有效性,同时帮助企业通过不断的改进,逐步提高产品质量,提升企业的竞争力,最终实现企业的可持续发展。
